Terms of Service

These Terms of Service ("Terms") govern your use of LATdx and related services provided by Nebulity, LLC ("Nebulity", "we", "us", or "our").

By creating an account, purchasing a subscription, installing LATdx, or using our services, you agree to these Terms.

1. About LATdx

LATdx is a developer tool that helps Salesforce developers run and analyze Apex tests more efficiently.

LATdx runs locally on your machine and communicates directly with your Salesforce org. Your Apex code, Salesforce records, query results, test results, and Salesforce credentials are not transmitted to Nebulity servers.

2. Accounts

You are responsible for maintaining the security of your account and credentials.

You must provide accurate account information and promptly update it if it changes.

You are responsible for all activity that occurs under your account.

3. Subscription and Billing

Certain features require an active paid subscription.

Subscriptions renew automatically until canceled.

You may cancel your subscription at any time. Cancellation prevents future charges but does not automatically entitle you to a refund.

Refunds are governed by our Refund Policy.

We may change pricing in the future. Any pricing changes will not affect an already-paid subscription period.

4. License

Subject to your compliance with these Terms and an active subscription, Nebulity grants you a limited, non-exclusive, non-transferable license to use LATdx.

You may not:

• Resell or sublicense LATdx
• Remove copyright or proprietary notices
• Use LATdx in violation of applicable laws
• Attempt to bypass licensing, subscription, or security mechanisms

5. Acceptable Use

You agree not to:

• Use LATdx for unlawful purposes
• Interfere with or disrupt our services
• Attempt unauthorized access to accounts, systems, or infrastructure
• Use LATdx to distribute malware or malicious software

6. Intellectual Property

LATdx, including its software, documentation, branding, website content, and related materials, is owned by Nebulity and protected by applicable intellectual property laws.

These Terms do not transfer any ownership rights to you.

7. Availability

We strive to keep LATdx available and reliable, but we do not guarantee uninterrupted availability.

Features may change, be modified, or be discontinued over time.

8. Warranty Disclaimer

LATdx is provided "as is" and "as available."

To the maximum extent permitted by law, Nebulity disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Nebulity's total liability arising from or relating to LATdx shall not exceed the amount you paid to Nebulity during the twelve months preceding the claim.

Nebulity shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business opportunities, lost data, or business interruption.

10. Termination

You may stop using LATdx at any time.

We may suspend or terminate access if:

• You violate these Terms
• You engage in fraudulent or abusive activity
• We are legally required to do so

If we discontinue LATdx entirely, we may terminate subscriptions and access to the service.

11. Changes to These Terms

We may update these Terms from time to time.

Material changes will be posted on our website. Continued use of LATdx after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
